DMCA Policy

Khonbahuay (operated by A & J Guitars LLC, hereinafter referred to as "the Company," "we," "us," or "our") respects the intellectual property rights of others and expects our users and partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement that are reported to our Designated Copyright Agent identified below.

This policy applies to our brand website, mobile applications, and all associated kitchenware collections, including Prep Master, Smart Cooking, and Home Essentials.

1. Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, please report alleged copyright infringements taking place on or through our services by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Upon receipt of the Notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from our platform.

Your Notice must include the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  • Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or a detailed description).

  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., the specific URL or product SKU).

  • Your contact information, including your address, telephone number, and an email address.

  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedures

If you receive a notification that your content has been removed due to a copyright complaint, and you believe that the material was removed by mistake or misidentification, you may submit a Counter-Notice to our Designated Agent.

Your Counter-Notice must include:

  • Your physical or electronic signature.

  • Identification of the material that has been removed and the location where it appeared before removal.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • Your name, address, and telephone number.

  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Hong Kong if your address is outside of the U.S.), and that you will accept service of process from the person who provided the original infringement notification.

4. Repeat Infringer Policy

Khonbahuay takes intellectual property integrity seriously. It is our policy, in appropriate circumstances, to terminate the accounts of users or partners who are repeat infringers or who are repeatedly charged with infringement.

5. Liability Disclaimer

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. We suggest that you consult a legal advisor before filing a notice.
